What is a will?

A WILL controls assets that you own “in your name only” The Will directs the Probate Court in distributing your assets. Because Probate Court is a necessary step in administering a Will, your Will cannot and does not, avoid the costs or delays of Probate Court. Rather than avoid Probate Court, a Will requires Probate to be effective. If assets are owned jointly, in most cases, the surviving owner(s) assume the ownership when another owner dies. This avoids Probate Court. Until your death, owning property jointly can present some serious problems. The Probate Court determines the validity of a Will that is presented for administration should any of the heirs object to the validity of the Will and/or the intentions of the Decedent as directed in the Will.

If a loved one can no longer take care of themselves or has been determined to be incapacitated, there is often a concern that their assets (home, bank accounts, or other monetary assets) are in danger of being abused by another person, the Court may appoint a Conservator.
